If you or a loved one is ever bitten by a dog, what should you do? What are your legal rights? In this article, Toronto personal injury lawyer Andrew M. Lee discusses personal injury law with respect to Dog Bite Claims and what you should do if you are ever bitten by a dog.

Often, when someone is bitten by a dog, most people will want to seek medical attention to ensure there has been no spread of disease, such as rabies. Medical reports and documentation of injuries can be used for a legal claim, along with photographs and anything else that can be gathered from the scene. It’s important to note that in most cases, the claim will only be successful if the owner is identified. Victims of dog attacks should take steps to preserve the evidence and identify the dog owner if they wish to pursue a claim.

If one of your guests sustains a personal injury at a social event that you are hosting, what sort of liability could you potentially be exposed to? In this article, Toronto personal injury lawyer Andrew M. Lee discusses how recent case law looks at Social Host Liability and what this could mean for you.

Party holders should be cautious as Canadian law edges towards liability for social hosts, says Andrew Lee, the founder and principal of Lee and Associates Personal Injury Lawyers. He explains that the leading case in the area is a landmark 2006 decision where the Supreme Court of Canada rejected a claim of liability against the hosts of a bring-your-own-booze party by third parties injured after attending. However, the nation’s top court left the door open to future claims in the right circumstances.

“My advice for hosts is to be wary,” Lee says. “The way the case law is rapidly evolving, I think we could very well see a case in the not-too-distant future where a court will say social host liability does exist.”

Are you uncertain whether you have a Wrongful Death claim? At Advocate Daily, Andrew Lee discusses what families need to know

Read Andrew M. Lee’s latest article on Wrongful Death at AdvocateDaily.com. In the article, he discusses what family members should be aware of in the event that there is ever a wrongful death. If you need clarification or further assistance at any time, feel free to reach out to Andrew and his legal team.

Family members who have lost a loved one through the negligence of another person need to be aware that they can bring a wrongful death claim for damages under Ontario’s Family Law Act, says Toronto personal injury lawyer Andrew M. Lee.

“I would say that it’s important for anybody experiencing the loss of a loved one or who knows of someone who may be going through such a situation to consult with a lawyer and become aware of their rights. If a breadwinner dies, for example, and there are children involved and there’s a dependent spouse — especially if the breadwinner’s young — that can certainly provide for a very substantial claim,” says Lee, founder and principal of Lee & Associates Personal Injury Lawyers.

Andrew M. Lee finds his calling in personal injury

Andrew M. Lee was featured in AdvocateDaily.com. In the article, he discusses how he has found his calling in Personal Injury.

Toronto personal injury lawyer Andrew M. Lee feels as though he was made for plaintiff-side personal injury work.

“I’m a people person,” he tells AdvocateDaily.com. “I always figured I wanted to be in some field where I could interact with others. I never saw myself as a person who would be buried in paperwork.

“I wanted to help people and champion their causes, which has led directly to what I’m doing now,” adds Lee, the founder and principal at Lee and Associates Personal Injury Lawyers.

Still, the road to Lee’s dream job wasn’t entirely straight.

Unlike some of his classmates at Osgoode Hall Law School, “I didn’t have a father who was a lawyer or an uncle who was a judge.” Instead, he blazed his own trail to graduate in 1992, before joining a law firm known for its insurance defence work.

In more than a decade with the firm, during which he made partner, Lee felt the lure of the opposite side of the bar and began swapping his insurance company clients for injured individuals. Finally, in 2006, he decided to start his own firm, which is now devoted entirely to representing plaintiffs.

“It was a deliberate effort to build up my own client base, and start helping people instead of defending denied claims,” Lee says.

Still, he says his diversion to the defence side of the bar paid off.

Uber has become a disruptive innovation in the way people move, both globally and domestically. Between November 2015 and October 2016, an estimated 2.7 million people in Canada used the peer-to-peer ride service (Statistics Canada). With millions of rides per year in Canada, accidents while traveling in an Uber or a similar ride-sharing service are an unfortunate reality.

Uber’s Blanket Fleet Insurance Policy

In July 2016, Uber Canada announced that its drivers and riders in Ontario would automatically be covered by a blanket fleet insurance policy from the moment drivers make themselves available to accept a ride request to the moment passengers exit the vehicle.

Specifically,

If involved in an accident during an Uber ride (after the Uber driver has accepted a request, but before the customer/passenger has exited the vehicle), a claim can be made under the blanket fleet policy for any damages up to the policy’s third party liability limit of $2 million.

If the personal injuries are sustained in an accident after the Uber driver has made him or herself available on the Uber app, but before a ride request has been accepted, the third party liability limit is $1 million.

What this means for you

Whether you are an Uber driver, customer/rider, or a third party, you are covered up to the aforementioned policy limits. If the damages caused in the accident are above and beyond the limits of the blanket fleet policy, your personal injury lawyer may be able to pursue a claim against other potential defendants.

The blanket fleet policy will be reviewed periodically to ensure it continues to meet the needs of consumers and rideshare participants.
